SECTION I. SHORT TITLE

The short title for this Act shall be the “Commonwealth of Arcadia Penal Law”.

SECTION II. ENACTMENT

This Act shall be enacted immediately upon passage.

SECTION III. SEVERABILITY

If any provision of this Act or the application of any provision of this Act to any person or circumstance, is held invalid, the application of such provision to other persons or circumstances, and the remainder of this Act, shall not be affected thereby.

TITLE A—GENERAL PROVISIONS

ARTICLE 1. DEFINITION

§ 1.00 Definitions of terms used in this Act

For the purposes of this Act, the term -

(a) “Offense” - refers to any conduct for which a sentence to a term of imprisonment or to a fine is provided by any law of this Republic;

(b) “Violation” - refers to any offense for which a sentence to a term of imprisonment in excess of a day cannot be imposed;

(c) “Misdemeanor” - refers to any offense for which a sentence to a term of imprisonment in excess of a day may be imposed, but for which a sentence to a term of imprisonment in excess of five days cannot be imposed;

(d) “Felony” - refers to any offense for which a sentence of exile or a term of imprisonment in excess of 5 days may be imposed;

(e) “Crime” - refers to any misdemeanor or felony;

(f) “Person” - refers to an individual, and where appropriate, a corporation, a company, and an association; and

(g) “Public servant” - refers to any public officer or employee of the government, or any person exercising the functions of any such public officer or employee.
