CLASSICAL RICK v. SOPHEA F HOUSE

Argued March 2026 Decided March 27, 2026

On March 6, 2026, the President issued Executive Order No. 1418, which declared the Republic of Herseyaria and the Crowned Republic of Garonia to be territories of Krameria, thereby placing both regions under full civil and military jurisdiction of the Republic. It also nullified all prior treaties, administrations, and foreign claims and established interim territorial governments and governors. Rick argued that because no act of the National Congress authorised the annexation, governance, or military control of these territories, the EO was an unlawful expansion of executive power. The Republic failed to respond after requesting continuances, and the Court granted summary judgment. Prior to the ruling, the new Attorney General declared that the Republic declined to contest.

Held:

  1. Annexation, territorial governance and nullification of treaties are actions which are legislative in character and thus lie within the exclusive domain of Congress under Article 27 of the Constitution.
  2. The President’s Article 18 power to direct the “faithful execution of the law” presupposes that a law has been enacted by Congress.
  3. Executive Order No. 1418 constitutes an ultra vires exercise of executive power and is unconstitutional and void ab initio.
  4. Executive Order No. 1418’s enforcement and implementation are permanently enjoined; and any actions taken pursuant to said Order are null and void. </aside>
