1. The Secretary of the Interior shall have the power to regulate:
   1. The setout of solid waste for collection, including requirements that waste be stored in secured containers;
   2. A nationwide curbside organics and food waste collection program, including mandatory participation for residential buildings above a specified size and for commercial food establishments;
   3. The designation of commercial waste zones, under which licensed private carters are assigned to service businesses within defined geographic areas;
   4. The sale and distribution of expanded polystyrene ("foam") food and beverage containers and packing materials;
   5. The sale and distribution of single-use plastic carryout bags, and the provision of single-use plastic straws and stirrers on a customer-request basis only;
   6. Recycling requirements for paper, metal, glass, and plastic, including mandatory recycling for residential buildings, businesses, and institutions;
   7. Collection and disposal of electronic waste, including a manufacturer take-back program and a prohibition on disposal in general waste;
   8. Illegal dumping and littering, including fines and a public complaint reporting system;
   9. Rodent and pest mitigation in connection with waste storage and collection practices;
   10. Tracking, handling, and disposal of hazardous and household hazardous waste;
   11. Environmental marketing and recyclability labeling claims; and Public education and outreach campaigns on waste reduction, recycling, and composting.
   12. Regulations issued under this section may include civil and criminal penalties for noncompliance, including fines assessed on a per-violation and escalating basis for repeat offenders.
