1. A person is guilty of Developing Nuclear Weapons when they, without lawful authority granted by the federal government or the military—
   1. develop, produce, stockpile, transfer directly or indirectly, receive, otherwise acquire, retain, own, possess, use or threaten to use, or threaten to use, any nuclear or radioactive explosive, detonator or weapon; or
   2. assist a foreign state or any organisation to do any of the actions listed in Paragraph (a) of this Subsection.
2. Developing Nuclear Weapons shall be a First-Degree Felony.
