1. A person is guilty of Developing Chemical Weapons when they, without lawful authority granted by the federal government or the military—
   1. develop, produce, stockpile, transfer directly or indirectly, receive, otherwise acquire, retain, own, possess, use or threaten to use, or threaten to use, any chemical agent, poison or weapon; or
   2. assist a foreign state or any organisation to do any of the actions listed in Paragraph (a) of this Subsection.
2. Developing Chemical Weapons shall be a First-Degree Felony.
