1. A person is guilty of Developing Biological Weapons when they, without lawful authority granted by the federal government or the military—
   1. develop, produce, stockpile, transfer directly or indirectly, receive, otherwise acquire, retain, own, possess, use or threaten to use any biological agent, toxin, or weapon; or
   2. assist a foreign state or any organisation to do any of the actions listed in Paragraph (a) of this Subsection.
2. Developing Biological Weapons shall be a First-Degree Felony.
