The Department of the Interior may invoke eminent domain to obtain the land needed for the construction and the continued maintenance and improvement of the Rhodes Interstate System and for the Garon D. Forge MetroRail System; Provided, that the Department of the Interior shall provide provide fair compensation of market value to the States for the land obtained, and that the States may appeal to the Supreme Court if the amount of “fair market value” is in dispute.
