1. KBI actions shall be based on reasonable predicate and shall have a valid purpose under Section 3 of this Act.
2. Use of force by the KBI shall be objectively reasonable, recognising the rapid decisions required of Agents, without the consideration of hindsight or the Agent’s mens rea.
3. In executing Paragraph (2) of this Section, Agents shall consider the severity of the suspected crime, whether the suspect is an imminent threat to the life and safety of the Agent or others, and whether the suspect is resisting.
4. Agents shall consider whether a suspect is an imminent threat to the life of the Agent or others and whether non-lethal force can be used instead in deciding whether to use deadly force.
5. Where possible, Agents shall provide some warning to the suspect before using deadly force.
